Welcome to Sustinu! These Terms of Service (Terms) govern your use of the Sustinu web application and services (collectively, the Service), provided by Sustinu (we, us, or our).

1. Description of Service

Sustinu is a Material Intelligence Platform that helps businesses optimize packaging strategy, forecast costs, and track sustainability performance. The Service provides tools for data digitization (OCR), financial forecasting, supplier benchmarking, and CO2 estimation. While Sustinu provides data insights and reporting capabilities, it is a strategic support tool, not a substitute for professional legal or tax advice.

2. User Accounts

  • Registration: You must register for an account to use the Service. You agree to provide accurate, current, and complete information during the registration process.
  • Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
  • Eligibility: You must be at least 18 years old and have the legal authority to represent your business to use this Service.

3. User-Generated Content & Data Use

  • Your Data: You retain full ownership of all the specific data you upload or create within the Service, including invoice files, extracted text, and supplier details (User Content).
  • Operational License: You grant us a license to process, store, and display your User Content solely to provide the Service to you (e.g., calculating your specific fees).
  • Aggregated Benchmarking Data: You agree that Sustinu may use your User Content in an anonymized, aggregated format to generate industry benchmarks, indices, and trends (e.g., the 'Peer Benchmark Matrix'). This aggregated data will never identify you, your business, or your specific suppliers to third parties.

4. Privacy and Cookies

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

5. Subscriptions and Payment

  • Service Tiers: The Service may be offered across various tiers, which may include a free plan with limited functionality and one or more paid subscription plans (Paid Subscriptions). The specific features, limits, and current pricing for all plans are detailed on our official Pricing Page, which is incorporated by reference into these Terms.
  • Billing: Paid Subscriptions are billed in advance on a recurring basis (e.g., monthly). By purchasing a Paid Subscription, you authorize us and our third-party payment processor (Mollie B.V.) to charge your selected payment method for the recurring fees.
  • Cancellations: You may cancel your Paid Subscription at any time through your account settings. The cancellation will become effective at the end of your current billing period. No refunds or credits will be provided for partial subscription periods.
  • Fee Changes: We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any price changes. Your continued use of the Service after a price change constitutes your agreement to pay the modified fee.

6. Acceptable Use

You agree not to use the Service to:

  • Upload or transmit any data that is unlawful, harmful, or infringes on the rights of others.
  • Attempt to gain unauthorized access to our systems or another user's account.
  • Disrupt or interfere with the security or performance of the Service.

  • Third-Party Supplier Data: The Service may include information regarding third-party suppliers, including but not limited to their sustainability certifications, regulatory compliance, and operational status (e.g., Official or Verified badges). Such information is provided for convenience and informational purposes only. Sustinu does not verify, monitor, or guarantee the accuracy, completeness, or current status of any third-party supplier data. You are solely responsible for conducting your own due diligence before engaging with or relying on the status of any third-party supplier listed within the Service.
  • Limitation of Liability: To the maximum extent permitted by law, Sustinu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.
